Terms and Conditions

Last updated: 11 September 2026

These terms govern your use of www.darbagency.com. By using the site you accept them. If you do not accept them, please do not use the site.

1. Who we are

This site is operated by DARB GROUP LIMITED, trading as DARB Agency.

  • Registered in England and Wales, company number 16756223

  • Registered office: 167-169 Great Portland Street, 5th Floor, London, W1W 5PF

  • Email: hello@darbagency.com

  • Telephone: +44 7741 513366

In these terms, “we”, “us” and “our” mean DARB GROUP LIMITED. “You” means the person using the site.

2. Using the site

You may view the site and print or download extracts for your own reference or to evaluate working with us. You must not:

  1. Copy, republish or redistribute any part of the site for commercial purposes without our written permission.

  2. Use the site in any way that is unlawful, or that could damage it or interfere with anyone else’s use of it.

  3. Attempt to gain unauthorised access to the site, the server it sits on, or any connected system.

  4. Use any automated system to scrape, harvest or reproduce the site, other than for ordinary search engine indexing.

  5. Introduce any virus, worm or other malicious code.

We may withdraw or suspend access to the site, or any part of it, at any time and without notice.

3. Our content and intellectual property

We own or licence all content on this site, including the DARB name and logo, the text, photographs, films, designs, layout and code. It is protected by copyright and other intellectual property rights under the Copyright, Designs and Patents Act 1988 and equivalent laws elsewhere.

Client names, logos and trade marks shown in our portfolio belong to their respective owners. They appear to identify work we have carried out and their appearance does not imply any endorsement by those owners.

Nothing on this site transfers any right in our work to you. If you want to use something from the site, ask us.

4. Accuracy and portfolio work

We take care over what we publish here, and we keep it current. Even so, the site is provided for general information. Case studies and portfolio pieces describe work we have done for particular clients with particular briefs and budgets. They are not a promise of the same outcome for you.

Nothing on this site is an offer capable of acceptance. It is an invitation to get in touch. Any engagement between us begins only when we have both signed a written agreement.

5. How we work with clients

The terms below give you the shape of an engagement. They are a summary, not the contract. The signed proposal, statement of work or services agreement between us governs the work, and where it differs from this page, the signed document wins.

  1. Quotes. We quote in writing, in pounds sterling, and a quote stands for 30 days unless it says otherwise.

  2. Payment. Our standard structure is 50 per cent invoiced before work begins and the remaining 50 per cent due on the first day of the shoot. Invoices are payable by the date stated on the invoice or in the signed agreement.

  3. Late payment. Overdue business invoices carry interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

  4. Intellectual property. We retain copyright in everything we produce until we have been paid in full. Once payment clears, you receive the licence or assignment set out in the signed agreement, on the media, territory and duration it specifies. Use beyond that scope is chargeable.

  5. Raw material. Raw footage, unedited photographs and project files remain ours unless the signed agreement expressly transfers them.

  6. Cancellation. If you cancel a confirmed shoot, the deposit is not refundable, because we will have turned other work away and committed crew and kit. A cancellation close to the shoot date is chargeable. The signed agreement sets the notice periods and the charges that apply.

  7. Revisions. Each engagement includes an agreed number of revision rounds. Further rounds are chargeable.

  8. Portfolio. We may show completed work in our portfolio and on our channels, unless the signed agreement restricts it.

We do not sell products or services for purchase through this website. Nothing here is a distance contract with a consumer. If you are engaging us as a consumer rather than for business purposes, tell us, because your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 will apply and we will set them out in the agreement.

6. Links to other sites

Where we link to another website, we do so because we think it is useful. We do not control those sites, we do not endorse them, and we are not responsible for their content or their handling of your data.

7. Our liability

Nothing in these terms limits or excludes our liability for:

1. Death or personal injury caused by our negligence.

2. Fraud or fraudulent misrepresentation.

3. Anything else that cannot lawfully be limited or excluded.

Subject to that, and in relation to your use of this website only:

4. We provide the site as it is. We do not promise it will always be available, uninterrupted or free of errors, and we do not promise the site or its server is free of viruses.

5. We are not liable for any loss of profit, loss of business, loss of anticipated savings, loss of data, or any indirect or consequential loss arising from your use of the site or your inability to use it.

6. Our total liability arising out of your use of this website is limited to £100.

The limits in this clause apply to the website. Our liability for work we carry out for clients is set out in the signed agreement for that work, which contains its own cap.

If you are a consumer, nothing in this clause affects your statutory rights.

8. Your data

We handle personal data as set out in our Privacy Policy and our Cookie Policy. Please read them.

9. Changes to these terms

We may change these terms. The date at the top shows when we last did. The version in force is the one published when you use the site.

10. Governing law

These terms, and any dispute arising out of them or out of your use of the site, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your own courts.

11. General

  1. If any part of these terms is found to be unenforceable, the rest continues to apply.

  2. If we do not enforce a term straight away, that does not mean we have given up the right to enforce it later.

  3. A person who is not a party to these terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
